Judges Prefer To Grant Early Termination Of Supervised Release
Video Transcribed: Early termination of supervised release. Who qualifies, and how likely are you to succeed in getting it? My name’s Ted Hasse. I’m an Oklahoma Federal Criminal Defense Attorney practicing in federal and tribal courts in Oklahoma.
I have received many calls from clients seeking to get off supervised release. Supervised release is where you’ve served some period of incarceration, and then you are released. It’s a little like what people think of parole, though there is no parole in the federal system.
What people need to know about the supervised release is that when given the right defendant, I find that judges like to grant early termination of supervised release. What I find is that you’ll be going back to the same judge that sentenced you, and if you can tell him a story about how you have served your time the right way, come out, and been handling yourself the way that they would want you to, judges are frequently looking for reasons to cut you a break on supervised release.
Now, who qualifies? Once you have served one year of supervised release, you can qualify for early termination. I have seen circumstances where people have had many years cut off their supervised release, and very early.
