Domestic Crime Charges Are A Serious Matter

I’m an Oklahoma Federal Criminal Defense Attorney practicing in federal and tribal courts in Oklahoma. Here’s what you need to know about domestic violence charges in Muskogee Creek Nation.
It’s one of the most serious charges and one of the charges that can be most challenging to get the Attorney General’s office to offer deals on. Internal dynamics within the nation can make it hard on the Attorney General’s office.
One of the things is that there are domestic violence advocates that are assigned to each of the complaining witnesses or alleged victims. It can be difficult for the Attorney General’s office to make a deal when they have those advocates watching over their shoulders.
One of the trends I’ve been seeing is that on felony domestic violence charges, it’s at least half, but maybe three-quarters of the cases I’m seeing come through that are a felony, including a claim of strangulation.
And it seems exceedingly unlikely that some sort of strangulation occurs 50% or 75% of the time. What possibly is happening is that it could be that law enforcement is deliberately or inadvertently coaching complaining witnesses into stating that they were strangled in some way.
I have had significant success in dealing with these charges. Certainly, you will want to find a good advocate if you’re facing these charges, domestic violence with strangulation or misdemeanor domestic violence.
